East African Court of Justice Rules Tanzanian Media Law Violates Press Freedom (March 28, 2019) [1]
On March 28, 2019, the East African Court of Justice ruled [3] in Media Counsel of Tanzania and Others v. Attorney General of Tanzania that multiple sections of Tanzania’s 2016 Media Services Act violated the Treaty for the Establishment of the East African Community in regard to freedom of the press and freedom of expression. Three civil society media organizations brought the claim, arguing that several provisions of the Act create “an unjustified restriction on the freedom of expression.” In particular, they argued that the Act violates freedom of expression by restricting certain content without a reasonable justification; criminalizing defamation, the publication of false news and rumors, and seditious statements; and granting the Minister for Information the power to prohibit the import of publications and to sanction media content. The Court found that these sections violated the Treaty and directed Tanzania “to take such measures as are necessary, to bring the Media Services Act, into compliance with the Treaty.”
