On August 16, 2018, the Inter-American Commission on Human Rights (IACHR) granted precautionary measures to migrant children separated from their families as a result of recent U.S. immigration policies. As noted in the press release, the IACHR issued two resolutions in which it “reiterated that, under the principle of complementarity, the State, through its domestic authorities, is primarily responsible for protecting the human rights of the persons under its jurisdiction” and requested information from the United States regarding reunification of these families. The Commission noted that even though the United States made efforts at reunifying the children with their families, it was unclear when or if all children would be reunited, and consequently, “the Commission concluded that the rights to family life and personal integrity as well as the right to identity of the children proposed as beneficiaries, are, in principle, at risk.” The IACHR requested that the United States (a) adopt measures to protect the rights to family life; (b) adopt measures to allow communication between children and their families, and also provide medical and psychological assistance; (c) take steps to guarantee reunification for children who were deported separately from their parents; (d) suspend migration procedures that may separate children from their parents; and (e) agree on the measures to be adopted regarding the children and those representing them.
